These Terms of Service ("Terms") govern your access to and use of the War Trades website, content, community, memberships, and educational products (collectively, the "Services"), operated by Jose Gonzalez doing business as War Trades ("War Trades," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. What We Provide

War Trades offers educational content about trading and market analysis, including written material, videos, a members' community, and paid memberships or courses. The Services are provided for educational and informational purposes only. We are not a broker-dealer, investment adviser, financial planner, or fiduciary, and we do not provide personalized investment advice.

3. Educational Purpose Only — Not Financial Advice

Risk disclosure. Trading and investing involve substantial risk of loss and are not suitable for every person. You can lose some or all of your capital. Leverage and margin can amplify losses. Never trade with money you cannot afford to lose.

No guarantee of results. We do not guarantee any particular outcome, profit, or performance. Past performance, examples, and testimonials are not indicative of future results. Any results discussed are not typical and your results will vary.

Hypothetical and illustrative results. Examples, backtests, and trade breakdowns may be hypothetical or illustrative. Hypothetical performance has inherent limitations: it is prepared with the benefit of hindsight, does not involve real financial risk, and cannot fully account for the impact of real-time market conditions. No representation is made that any account will achieve results similar to those shown.

4. Memberships, Billing & Refunds

Certain Services require a paid membership or one-time purchase. Payments are processed by third-party providers (currently Whop, and where applicable Stripe), and your purchase is also subject to their terms. We do not store your full payment card details.

• Subscriptions renew automatically at the then-current price until you cancel. You may cancel at any time to stop future renewals; cancellation takes effect at the end of the current billing period.
• All sales are generally final, and fees for digital products, memberships, and subscriptions are non-refundable, including for partial periods. That said, we want every member treated fairly: if something goes wrong, reach out and we will review your situation and work to make it right at our discretion. Nothing here limits any rights you may have under applicable law.
• We may change prices or features on a going-forward basis; changes will not affect a billing period you have already paid for.

5. Acceptable Use

You agree not to: (a) share, resell, or redistribute paid content or community access; (b) reverse engineer, scrape, or copy the Services; (c) use the Services for unlawful purposes or to harass others; (d) misrepresent your affiliation with War Trades; or (e) interfere with the security or operation of the Services.

6. Intellectual Property

All content, materials, trademarks, and the War Trades name and branding are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable, non-exclusive license to access purchased content for your own personal use. No other rights are granted.

7. Community Conduct

If you access a community (such as a Discord server), you must follow its rules and applicable third-party terms. We may remove content or revoke access for conduct we consider harmful, abusive, or in violation of these Terms, without refund.

8. Third-Party Services

The Services rely on or link to third parties (such as Whop, Stripe, Discord, and Meta/Threads). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, War Trades and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading or investment losses, loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid to us in the twelve (12) months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless War Trades and its operator from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
